Description

  • Learn the proper methodology for calculating economic damages, information the forensic economist needs from the attorney and client to make the assessment, and sources the economist should consult for current data on which to base damages calculations.
  • More than 70 statistical tables, sample deposition and cross-examination questions, questionnaires for gathering essential information, and detailed hypothetical situations with step- by- step damage calculations are included.
  • Revised Chapter 6 Determining the Value of Non-Market Work covers the six steps to valuing non-market activities; a sample household production damages calculation; and sample cross-examination questions for the damages expert.
  • Expanded Chapter 7 Loss Duration; Life Expectancy; and Worklife Expectancy discusses when loss begins and ends; partial year calculations; determining worklife expectancy; and the Skoog/Ciecka/Krueger Worklife Tables.
  • New Chapter 16 Commercial Damages explains lost profits and lost business value measurement approaches including discussion of lost profits for a new business; lost profits involving uncertainty; and three approaches to business valuation.

Determining Economic Damages provides an integrated, practical framework to assist the damages expert, the client, and the client’s legal counsel in assessing economic damages involving personal and selected types of business and commercial losses. The book is loaded with practical forms, procedures, tables, and tactics from two veteran economists who have consulted on hundreds of cases.

Authors Stanley Stephenson, Ph.D. and David MacPherson, Ph. D. focus on six core issues in assessing economic damages: (1) pre-loss economic benefit level (wages/profits); (2) fringe benefits; (3) loss duration; (4) mitigation of loss; (5) choice of discount rate for calculating the present value of future losses; and (6) factors affecting growth in damages.

With this revision, the authors have expanded the scope of the book beyond personal losses to include damages in commercial disputes. The new commercial damages chapter focuses on two types of business damages: lost profits and lost business value. It considers what data is needed to determine commercial economic damages, presents lost profits and lost business value damages models, and concludes with a discussion of distinctions between the two.
