To the extent permitted by law, RUPES sole obligation and your exclusive remedy under this warranty is expressly limited to the replacement or repair, without charge, of those parts determined by RUPES to be defective. Power tools that have been subjected to misuse (including but not limited to overloading and use not specified in the user’s manual), neglect, faulty maintenance, alteration, damage caused by improper use of chemicals, repairs by unauthorized parties, or damage caused by normal “wear & tear”, are not covered. In the event the repairs are deemed non-warranty the repair charges shall be borne by purchaser.
